Does every estate have to go through probate?
No, but whether a particular estate does is a legal question that depends on what it holds and how it is titled. California has simplified procedures for smaller estates. Beacon cannot advise you on which applies; the court's self-help resources and an attorney can.
How long does probate take in California?
Formal probate commonly takes many months and often longer than a year, depending on the estate, the court's calendar and the creditor claim period. Beacon cannot promise a timeframe.
Can Beacon handle a contested probate?
No. If heirs are in dispute or the will is being challenged, that requires an attorney. Beacon will tell you that directly rather than take the work.
What is a small estate affidavit?
California provides a simplified affidavit procedure for estates under a published value threshold, which avoids full probate. Whether an estate qualifies is a legal question; the paperwork is document preparation and Beacon can prepare it at your direction.
Can Beacon act as executor for me?
No. A Legal Document Assistant cannot serve as the personal representative of an estate. Beacon prepares the paperwork; you administer the estate.
