- The exact legal name and address of the person or business you are suing
- For a business, its registered name and agent for service — a trade name on a sign is often not the legal name
- Documentation of the amount: invoices, receipts, estimates, photographs, texts or emails
- Any written demand you have already made
- Your case number and hearing date, if a case has already been filed

What commonly causes delays
General procedural information, not advice about your matter.
- 01Suing the wrong legal entity. A business's trade name is often not the name that can be sued, and a judgment against the wrong name is difficult to collect.
- 02Service has to be completed a set number of days before the hearing, and the number differs depending on where the defendant is.
- 03Serving by certified mail through the clerk works only if it is actually signed for.
- 04Small claims has dollar limits that differ for individuals and businesses, and a limit on how many claims over a certain amount you can file per year.
- 05Bringing the documentation to the hearing but never filing a proof of service means the hearing does not go ahead.

Can Beacon come to my small claims hearing?
No. Beacon cannot represent you or speak for you. In California small claims court, parties generally represent themselves and attorneys are not permitted to appear either.
How much can I sue for in small claims?
California sets dollar limits for small claims, and the limit is different for individuals and for businesses. The court publishes the current limits, and Beacon can point you to that published information.
I won but the other side has not paid. What now?
There is a separate set of forms for enforcing a judgment, including abstracts of judgment and wage garnishment paperwork. Beacon can prepare those at your direction.
What if I cannot afford the filing fee?
The court has a fee waiver request process. Beacon can prepare that request at your direction; whether it is granted is up to the court.
